Addressing an increasingly contentious issue, the Consumer Financial Protection Bureau has detailed its enforcement and compliance policy on fair lending. Importantly, the statement affirms the application of the disparate impact doctrine – which places the burden of disproving discrimination on lenders when their objectively neutral lending practices result in disparate impact to a protected class of borrowers.
